The family of Peter Muchoki Kinyenje is fighting over a 0.139-hectare piece of land valued at KSh 7 million.

Kinyenje had two wives, Leah Wairimu Muchoki and Esther Muthoni Muchoki, and six children. When he passed away, the beneficiaries were allocated pieces of land.

However, the family accuses Alexander Wanyoike Muchoki of irregularly allocating the land to himself without consulting other beneficiaries.

Public Corruption, Ethics, and Governance Watch (PCEGW) has urged the Directorate of Criminal Investigations (DCI) to investigate Wanyoike and Thika Law Courts Magistrate I.F. Koome, who presided over the succession case.

Leah's children are accusing the magistrate of colluding with Wanyoike to amend the certificate of grant after their mother died.

The group wondered why the magistrate could approve the change of the certificate of grant without involving the listed beneficiaries, as approved by the local chief.

"Why succession cause No.272 of 2016 in the matter of the estate of the late Muchoki Kinyenje, certificate of confirmation of a grant confirmed on 25th September 2017 without involving the beneficiaries listed in a letter from the area local chief?
"How did the suspects Alexander Wanyoike Muchoki and late Wairimu Muchoki receive letters of Administrators of the Estate of Late Muchoki Kinyenje without involving all the beneficiaries on March 7, 2002?" the group posed.

They have further accused Wanyoike of using forged signatures of beneficiaries, particularly that of Dabora Nyambura Muchoki, to illegally amend the written grant of representation to the estate of the late Kinyenje.

The group has given the DCI 30 days to charge Wanyoike with the offence of using forged documents to steal family.

They also want the Judicial Service Commission to take action against the Thika Law Courts magistrate who allegedly relied on forged documents to amend the grant.

"If our request is not going to be executed within 30 days starting above date, we will charge Alexander Wanyoike with an offence of stealing family land size 0.139 Hectares and acquiring a letter of Administration illegally without involving all beneficiaries. And also together with Hon. I.F KOOME for their illegal act of amending the grant using forged signatures when the beneficiaries were not before the court as required in law," they noted.
