Kenyan Newspapers, August 13: DCI Officer Arrested after Losing Firearm while Revelling with Woman

Elsewhere, a Directorate of Criminal Investigations (DCI) officer was arrested for the loss of his firearm while in an entertainment joint in Migori county.

1. The Star

The Star reported on the arrest of a Directorate of Criminal Investigations (DCI) officer over the loss of his firearm.

The police corporal, James King'ori, stationed at the Kuria West DCI offices, was taken into custody on Sunday night, August 10, after reporting the disappearance of his pistol under unclear circumstances at a bar in Kehancha town, Migori county.

The officer had been drinking with a woman when he noticed that his Duma pistol, which was loaded with 15 rounds, had gone missing.

According to witnesses, a stranger briefly interacted with the duo before the woman suddenly disappeared.

Authorities suspect she may have taken the firearm.

Both individuals were arrested around 9 pm, but efforts to locate the weapon in the vicinity were unsuccessful.

2. Daily Nation

The newspaper reported on the doubts cast on the Independent Electoral and Boundaries Commission (IEBC) as the commission prepares to hold minipolls in 24 areas; 17 wards, six constituencies, and one county.

The decision by the commission to declare November 27 as the date for the by-elections has been challenged by lawyers who argue the declaration is unconstitutional.

They warned that the move could open the door to court cases or even an order to stop the election.

The commission, headed by its new chairman, Erastus Ethekon Edung, has begun work amid strong criticism, with many fearing that it may create legal disputes instead of carrying out its duties in accordance with the constitution.

Through a government notice dated August 8, Ethekon officially announced that the by-election would be held on November 27, ending a long waiting period for citizens who lost their representatives.

However, counting 90 days from the date of the declaration of the vacancy ends the period too early, thus making the date of the election outside the time limit set by the Constitution.

Section 101(4)(b) of the Constitution requires the IEBC to hold by-elections within 90 days of a vacancy being declared by the Speaker of the respective House of Representatives.

Lawyer and Nairobi senator Edwin Sifuna was the first to criticise the IEBC.

"The Constitution is clear that by-elections must be held within 90 days of a vacancy. But this commission has started badly by blatantly violating the law," the senator said.

Others, including former Attorney General Justin Muturi, lawyer Kibe Mungai, Makueni governor Mutula Kilonzo Jr., Makueni senator Daniel Maanzo, and lawyer David Ochami, argued that the timeline announced by the IEBC was inconsistent with the constitution.

"It is impossible for a commission formed on the basis of respecting the law to start by violating the Constitution. They do not even seem to know how they decided on that date. This is a plan to delay the cases to remove sitting MPs. We are watching them from afar," said Muingai.

Others warned that this violation could open the door to multiple lawsuits against IEBC, which would lead to the misuse of public funds in defending itself in court.

"The Constitution does not change. The timing of elections is not changed. If they allow this small thing today, tomorrow the presidential election will be delayed by 15 days. They are wrong," said Mutula.

Senator Maanzo warned that the move could lead to the entire election process being declared null and void in court.

3. Taifa Leo

The newspaper spared a space for the 2024 African Nations Championship (CHAN) tournament, which has attracted controversy due to the conduct of some of the Kenyan fans.

The organising committee has urged fans to be disciplined and issued strict attendance guidelines for the Harambee Stars match against Zambia on Sunday.

This comes after the Confederation of African Football (CAF) reduced the number of fans who will be attending Harambee Stars matches at the Kasarani stadium to just 27,000. The stadium has a capacity of 48,000.

Nicholas Musonye, the organising committee chairman, blamed the fans for flouting CAF regulations and drawing Kenya’s wrath with fines and now a lack of fan numbers.

He asked those without tickets to stay away from the stadium.

4. The Standard

The newspaper also reported on the CHAN tournament, with Kenya risking having its home team matches taken outside the country.

CAF issued new measures after ticketless fans breached the Kasarani Stadium during the Kenya versus Morocco match on Sunday, August 10.

The confederation capped the stadium at 27,000 from the 48,000; CAF warned that further security breaches would attract further drastic measures, including Kenyan matches being played in alternative venues.

Kenya is cohosting the tournament with Uganda and Tanzania.

Interior Cabinet Secretary Kipchumba Murkomen warned ticketless fans against showing up at the stadium.

Football Kenya Federation (FKF) president Hussein Mohammed asked those without tickets to follow the matches on television.
