High Court Extends Order Stopping Auction of Raphael Tuju’s Karen Property

Nairobi: Former Cabinet minister Raphael Tuju has received a reprieve in an ongoing legal tussle between him and the East African Development Bank (EADB) involving his high-end property in Karen.

Tuju on Wednesday, May 7, secured another High Court order temporarily extending orders stopping the bank and Garam Investments Auctioneers from selling the property in a case involving a contested KSh 4.5 billion loan.

Which Tuju properties are facing auction?

In the orders issued by Justice Josephine Mongare, the court also stopped the forced sale of Dari Business Park at Ksh 590 million for market value and KSh 442.5 million and Entim Sidai Wellness Sanctuary valued at Ksh 1.395 billion for market value and Sh1.046 billion.

The judge directed that the status quo be maintained until June 24.

The court order was issued after Tuju, through his lawyers, filed the application seeking to stop the auction of his luxurious property by Garam Investments Auctioneers. The application followed a contested valuation report.

His lawyer, Paul Nyamodi, has since issued a cease-and-desist notice to Ultra Eureka Limited, the company claiming to have acquired one of the contested properties through a public auction in 2024.

He accused it of interfering with tenants occupying the property.

In the letter addressed to the company, Nyamodi demanded that it stop harassing, provoking, intimidating or disrupting the tenants’ peaceful occupation of the premises.

“As you are well aware, the property is the subject of litigation in various suits, including HCCOMM No. E636 of 2024. Our client in the said matter obtained an injunction barring dealings with the property,” read part of the letter seen by TUKO.co.ke.

Tuju, in the letter, argues that Ultra Eureka had written to the tenants on April 30, claiming ownership of the property and instructing them to redirect rent payments to the firm or face legal action.

He noted that the notice is contrary to an existing court order, hence any transfer of the property in question was unlawful.

“Through your letter, your client now seeks to compound the contempt by interfering with our client’s peaceful possession of the property and harassing his tenants,” Tuju’s lawyers noted.

Tuju is entangled in a legal battle with the East African Development Bank (EADB) over a contested KSh 4.5 billion loan borrowed by his company, Dari Ltd, in 2015.

Court documents show Tuju’s lawyers also wrote to Chief Land Registrar David Nyambaso Nyandoro on December 2, instructing him to register the court order and prevent any further dealings or transfer of the property.

“In addition, we request that the Deed File thereafter be kept in your custody or that of your deputy to prevent any unauthorised dealings, pending resolution of the suits in court,” the letter stated.

Despite the court’s directive, the transfer of the property allegedly proceeded on February 18, 2025, raising fresh concerns over compliance with judicial orders.

He further claimed the sale notices issued on July 24, 2024, are illegal and unenforceable. Tuju is seeking a permanent injunction to bar the bank from selling, advertising, or interfering with the properties.

Lands officer in trouble over Tuju property auction

TUKO.co.ke previously reported that a senior lands officer was set for fresh scrutiny over his role in the controversial auction of a property owned by Tuju.

Busia senator Okiya Omtatah filed a case seeking to introduce new evidence against the official.

Omtatah argues the official acted in clear disregard of an existing court order stopping the transfer or auction of any properties owned by the former Cabinet minister.
