Nairobi Businessman Arraigned in Ksh 5.9 Million Fraud Case Involving Fake Rice, Sugar Deal

Nairobi: A businessman has been arraigned at the Milimani Law Courts over allegations of defrauding a woman of more than KSh 5.9 million in a suspected fake food supply deal.

The accused, Samuel Karuga Wachiuri, appeared before Senior Principal Magistrate Caroline Mugoi, on Monday, May 26, where he was charged with obtaining KSh 5,921,600 from Grace Irungu under false pretenses.

How Nairobi woman was defrauded of KSh 5.9m

According to the prosecution, Wachiuri is alleged to have committed the crime between May 6 and 15, 2025, in Nairobi County. He is alleged to have posed as a supplier capable of delivering 3,000 bags of rice and 250 bags of 50kg sugar. However, he allegedly failed to honour the agreement after receiving payment.

Court documents seen by TUKO.co.ke indicate that the money was deposited by Irungu mobile money platform M-Pesa into company bank accounts linked to the accused.

In a dramatic turn, the prosecution further claimed that after the complainant reported the incident to the police, the accused allegedly threatened to leak photos of the two in an attempt to coerce her into dropping the charges.

An affidavit filed by Patricia Mwendwa, an officer attached to Athi River Police Station, revealed that the accused had vowed to share compromising images on social media to ruin Irungu’s family and reputation.

“The accused has been threatening the complainant to post on social media her compromising photos with him to ensure he ruins her family and public image if she does not withdraw the case,” the affidavit read in part.

Wachiuri denied the charges and pleaded not guilty.

He applied to be released on bail, an application the prosecution rejected.

“Although the Constitution makes provision for the accused persons to be released on bail or bond on reasonable conditions, it is not absolute but a matter of discretion on the part of the court,” the prosecution said.

The court is set to rule on his bail application on Wednesday, May 28.

Fraud case involving 3 Nairobi businessmen

Previously, TUKO.co.ke reported a similar fraud case involving three Nairobi businessmen who had been arraigned before the court over a prime property dispute.

The three, Atek Otech Richard, John Gitau Ngumi, and Bernard Otieno Mallo, are alleged to have conspired to defraud a Nairobi company of land in Loresho, valued at over KSh 1.6 billion.

They faced six counts, including falsely claiming to be the owners of the said parcel of land, all of which they pleaded not guilty.
