Why Mukhwana decided to tell truth about Ojwang's death

In a witness statement seen by TUKO.co.ke, Mukhwana clarified that the reason behind his revealing the truth on how events unfolded on the night Ojwang died was that he figured he was being used as a scapegoat in the case.

The suspect stated that when he was first summoned by the Independent Policing Oversight Authority (IPOA), he decided not to reveal much.

He argued that his reason for withholding information was that he thought he and his colleagues were meant to cover for each other.

"I came to the IPOA and recorded a statement, but I did not disclose what happened. I thought we were to cover each other, but later, I discovered my colleagues had pinned the blame on me, which was on June 11, 2025," Mukhwana's statement read in part.

Upon this realisation, Mukhwana stated that he decided to tell the truth as it was. He presented himself at the IPOA offices on June 12.

However, he was arrested when he reached the offices and taken to the Capitol Hill Police Station.

Mukhwana stated that he got an opportunity to speak with the senior assistant director of investigations at IPOA, Abdirahman Jibril, and told him that he wanted to record another statement.

"He promised that he would return with Nyakundi, whom they came I narrated the whole truth while at Capitol Hill Police Station. They promised that I would be taken to court after I recorded my statement," he added.

On June 13, Mukhwana was presented in court on a miscellaneous application. The court made a ruling that he should be detained at the Capitol Hill Police Station until June 20.

Mukhwana, sounding remorseful, noted that Ojwang was not supposed to be killed, just disciplined according to the instructions allegedly given by OCS Samson Talam.

Additionally, he claimed that Talam had received instructions from the Deputy Inspector General of Police, Eliud Lagat.

"I am sorry for the death of Ojwang. May God help them to heal from the loss. I know it is painful," Mukhwana said.

Did Talam warn Mukhwana against defying orders?

The officer also took the moment to allege that OCS Talam had warned him about defying orders to have Ojwang disciplined at the station.

Mukhwana further stated that following the alleged threats, he gave KSh 2000 to a remandee identified as Ngige for him to recruit inmates who would allegedly attack Ojwang.

He also bought alcohol for Ngige and his counterparts, as they stated that they needed to be under the influence to be able to perform the task.

Mukhwana added that after finishing up, he left Constable Kimani in charge of cell duties, which involved coordinating the inmate movements shortly after Ojwang was brought in.
