It is a consequence that formulators of the 2010 Constitution never envisaged when they allowed picketing under the law.
Did Nakuru residents apprehend a goon?

The incident unfolded in Nakuru, where thousands of demonstrators had turned out to honour the victims of the June 25, 2024, protests.
While most of the day’s events remained peaceful, the tension quickly escalated when reports of looting surfaced near a Safaricom shop in the central business district.
According to witnesses at the scene, the young man, believed to be among a group of opportunists trying to infiltrate the protests, was apprehended by the crowd.
A video that has since gone viral shows the suspect, panicked and desperate, in an empty water tank in a frantic bid to avoid being lynched by the angry mob.
"There is a man inside this bin who is one of those who were stealing and causing destruction in this area; in this Safaricom shop that you see here. He was arrested after being found hiding inside this bin. And members of the public are trying to pull him out," a man is heard narrating.
Why did Nakuru police not save cornered goon?
In the footage, boda boda riders and protestors surround the tank, some tipping it over while others shout at the man to come out.
There is visible frustration from the crowd, with many trying to hit the tank while insisting they would not allow thugs to hijack what they described as a peaceful march.
The crowd’s anger was further stoked by the brief presence of police officers, who arrived at the scene in an attempt to protect the suspect.

However, officers were reportedly forced to withdraw after their efforts were overwhelmed by the sheer number of residents demanding justice on the spot.
"Police officers had been here, although they left the scene. The officers withdrew after trying to protect him, but it proved impossible," the narrator added.
The 2010 Constitution enshrines the right to peaceful assembly and picketing, but the recent trend of looting and destruction by opportunists has threatened to delegitimise genuine civic action.
How many victims were reported during the June 25 demos?
As earlier reported, the June 25 demonstrations turned deadly with 11 people killed and around 400 injured, many from gunshots, as police used live ammunition, tear gas, water cannons, and batons.
The Independent Policing Oversight Authority (IPOA) is investigating all deaths, one victim was a Form 3 student shot in Molo and has documented excessive force and officers concealing identities.
In Nairobi CBD, two protesters were critically injured and rushed to Kenyatta Hospital, captured in footage that sparked public outcry.
