In a case filed at the High Court in Nairobi on Monday, July 14, the family is seeking to compel the Inspector General of Police, Douglas Kanja, and the Directorate of Criminal Investigations (DCI) to produce their kin.

The family argues that Abdirahman went missing under mysterious circumstances.

What was Abdirahman Mohamed's last event?

In a habeas corpus application, the family, through lawyers Shadrack Wambui and Danstan Omari, stated that the Huduma Centre manager was last seen at a public function in Wajir. At the time, he was part of the delegation that welcomed the Cabinet Secretary for Public Service, Geoffrey Ruku.

According to the family, shortly after the event, Abdirahman vanished without a trace, prompting them to file a missing person’s report at the Sojir Police Station.

The application names the Attorney General, Inspector General of Police, and the Director of Public Prosecutions (DPP) as respondents, alleging their failure to act or disclose Hussein’s whereabouts.

“Abdirahman is a public servant of repute, holding dual roles as assistant county commissioner and manager at Wajir Huduma Centre. His disappearance raises serious constitutional concerns. He was not known to have any feuds or enemies, making the incident even more disturbing," lawyer Omar stated in court documents seen by TUKO.co.ke.

He further noted that the public servant may be held incommunicado, and that state agents have a duty to investigate, find, and produce him before the court.

The application wants the court to order his production on Monday, July 14.

“There is justifiable reason to believe that the applicant is held/detained incommunicado, and that the 1st, 2nd and 3rd respondents are directly tasked to seek to investigate, find and produce the person and/or body before this honourable court,” court papers read in part.

When was Abdirahman Mohamed reported missing?

Photographs annexed in the affidavit show the missing Huduma Centre manager seated among other dignitaries during the CS’s address in Wajir. Despite the police report filed by the family on July 10, they say no progress has been made, further heightening fears of unlawful detention or abduction.

“This honourable court is called upon to safeguard the applicant’s fundamental rights under Articles 25 and 51 of the constitution. Unless the Court intervenes, the rights of the applicant will continue to be violated,” reads the motion.

“No Kenyan can disappear without a trace. Despite public concern, there has been no communication,” the family noted.

Missing Kericho Form Four boy found safe
