Bethuel Chesir: High Court Orders Production of Missing Marakwet East MP’s PA, Dead or Alive

The Eldoret High Court has ordered state authorities to produce missing Marakwet East MP Bowen Kangongo’s personal assistant, Bethuel Chesir, dead or alive.

In his ruling delivered, Justice Patrick Otieno certified the case as urgent and issued a habeas corpus order directed at the Inspector General of Police, Douglas Kanja, and the Attorney General, Dorcas Oduor.

The court instructed the respondents, their agents, or representatives to present Chesir’s body before Courtroom Number 1 at the Eldoret High Court, no later than 11am on the specified date.

"Respondents by themselves, their agents and or representatives to have the body of Bethuel Chesir produced before this honourable court, at the High Court, Court room Number 1, dead or alive, forthwith and not later than the 14.8.2025 at 11 am," Justice Otieno ruled.

What happens if Chesir is not in court?

He further ordered that if the directive is not complied with, the named respondents must personally appear in court, accompanied by legal counsel and the investigating officer, armed with any warrant of arrest or detention order.

As per the order seen by TUKO.co.ke, they will be required to explain why Chesir should not be released immediately.

"If there shall not have been compliance as ordered of production as above, an order is hereby issued that the respondents by selves and responsible agents shall appear in person, and may be accompanied by counsel and the investigating officer when armed with the original of any warrant of arrest or order of detention, on the 14.8.2025, to show cause why the said Bethuel Chesir should not be released forthwith," read the order in part.

The ruling followed a petition filed by Chesir’s family, who accuse security agencies of failing to account for his whereabouts six days after he was allegedly abducted in broad daylight.

What happened to Bethuel Chesir?

Family members claim Chesir was taken on Tuesday, August 7, by eight armed men believed to be police officers.

The incident occurred at Kaptagat Forest along the Eldoret-Eldama Ravine Highway, as he drove from Nairobi to Eldoret to visit his ailing father, admitted at Moi Teaching and Referral Hospital.

Family spokesperson Richard Kiptoo recounted that two vehicles followed Chesir from Nairobi.

At Kaptagat Forest, one overtook and stopped abruptly in front of him, while the other blocked his car from behind.

Armed men carrying G3 rifles emerged, ordered him to lie on the ground, and asked for his identity.

The family says they have searched extensively in hospitals, morgues, and police stations across the country but have found no trace of him.
