According to a statement seen by TUKO.co.ke, the petition was filed by two members of the party, identified as Ruth Auma and Fred Wanyonyi Marango.

"Our clients have placed instructions on our desk vide the Petition dated 31st July, 2025, which we now forward to you herewith for your attention and appropriate action. Kindly acknowledge receipt of this letter," the petition filed through Makaka and Associates advocates read in part.

Why petition seeking Wamalwa's removal was filed

According to the two, the political party has experienced instances where there was misappropriation of funds.

"The party leader has on several occasions and without authority from NEC, requested money from party elected leaders purportedly on behalf of the party but used the money for his adventures," they stated.

Some party leaders have also resorted to not paying their monthly subscription fees, as they were made to believe that the amount they gave Wamalwa was the subscription fee, the petitioners argued.

This has left the party the party struggling financially, thus making it hard for activities to run effectively

"The party leader, using his 'advisors' mentioned above, has borrowed money from shylocks on behalf of the party without the knowledge and consent of the NEC, thus forcing the party to be in debt and pay for loans it did not benefit from," they added.

Wamalwa is also accused of being involved in nepotism, where he employed his cousin, Dan Wafula, as Trans Nzoia's county executive officer. Following this, he compelled the party to pay him a salary.

Seemingly implying that Wamalwa was wrong, the members argued that the position his cousin occupied does not exist in the party.

Abraham Wanyonyi, who is also a relative of Wamalwa, was appointed as a trustee and NEC member of the party, a position they stated does not exist.

"The party trustee has been soliciting for and signing for loans from shysters ostensibly on behalf of the party, but the money is given to the party leader. It is for the above reasons and for the party to function legally and properly to meet its objectives as set out in the party Constitution, party manifesto and various party policies that we petition the NEC through you, to remove the said Eugene Wamalwa from being the party leader of DAP-K," they finalised.

Did George Natembeya push for reforms of party?

This comes days after the Trans Nzoia governor, George Natembeya, demanded reforms to boost the party's national appeal.

He stated that the members of the party are at a crossroads on whether to invite new people into the party or let it remain as it is.

According to him, DAP-K is a liberal party asserting that it belongs to the people of Kenya, not to Wamalwa, the current leader.

"Politics is not about Western Kenya. That is the challenge that we have. Others are against opening the doors for other Kenyans to expand DAP-K, because we know it has potential," Wamalwa said.
