Isiolo: New Twist as Court Declines to Lift Degazettement of Mohamed Roba as Assembly Speaker

Nairobi - Isiolo county politics has taken a new twist following orders issued by the Milimani Law Courts.

On Friday, July 11, Mohamed Roba suffered a major blow after Justice Bahati Mwamuye declined to lift his degazettement as Isiolo County Assembly Speaker.

Who is Abdullahi Jaldesa Banticha?

A group of activists under Operation Linda Jamii had moved to court seeking orders to suspend the gazettement of Abdullahi Jaldesa Banticha as the new speaker.

The petitioners wanted the court to order that pending the inter-party hearing of the application, Banticha be prohibited from forcibly taking over the office of Speaker of the County Assembly of Isiolo.

They also wanted the court to order the Attorney General to revoke the gazette notice No. 8667 that appointed Banticha as the Speaker of Isiolo County Assembly.

They further wanted Banticha and Clerk Salad Boru to be barred from enjoying the benefits that come from the offices they hold.

Which orders did Justice Bahati Mwamuye issue?

But in his ruling, Justice Mwamuye declined to grant the orders sought but directed the petitioner to serve the application, petition, and directions on all five respondents and all 20 interested parties.

According to the judge, the respondents and interested parties shall enter an appearance and file and serve their respective responses to both the application and the petition by close of business July 16, with the rejoinder to be filed and served by close of business July 21.

"The Respondents and Interested Parties shall enter appearance and file and serve their respective responses to both the Application and the Petition by close of business 16/07/2025," Justice Mwamuye ordered in a ruling seen by TUKO.co.ke.

The Clerk of the Assembly had gazetted Banticha as the new speaker and circulated a memo at the county informing staff of the new board.

This saw the exit of the embattled speaker in the ongoing drama in an attempt to impeach Governor Abdi Guyo.

Guyo and Roba had been close friends before they fell out.

A court stopped the process and termed it null and void, and summoned Roba to explain why he could not be cited for contempt.

How did Abdi Guyo survive impeachment?

The ruling comes a few days after Governor Guyo survived an impeachment motion at the Senate.

On Tuesday, July 8, 31 senators voted to approve the motion contesting the procedure used by the Isiolo County Assembly in impeaching Guyo.

Senate Majority Leader Aaron Cheruiyot moved a motion on the preliminary issues after the embattled governor contested whether MCAs held a sitting.

At least 12 senators voted against the motion after Speaker Amason Kingi ruled that the Senate should determine by vote the preliminary objection on whether the County Assembly of Isiolo sat and debated the ouster motion.
